Acceptance of These Terms

By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

Eligibility

You must be at least 18 years old (or the age of majority in your place of residence) to use the App. By using the App, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

Changes to These Terms

We may update these Terms from time to time. The updated Terms will be effective as of the "Effective Date" shown above. Your continued use of the App after any update constitutes your acceptance of the updated Terms.

The App and Services

Yuna is a subscription-based wellness and nutrition tracking application that may provide features such as food logging, calorie and macro tracking, streaks, insights, and access to dietitians for general educational guidance.

We may add, modify, or remove features at any time, and we do not guarantee that any particular feature will always be available.

No Medical Advice; Dietitian Disclaimer

The App provides nutrition, wellness, habit, and lifestyle information for general informational and educational purposes only. Nothing in the App is intended to be, and should not be construed as, medical advice.

Dietitian interactions within the App are not personalized medical treatment and are not a substitute for diagnosis, treatment, or care by a licensed physician or other qualified healthcare provider. Dietitians accessed through the App do not diagnose, treat, or cure any medical condition, and the App is not intended to be used for the prevention, diagnosis, or treatment of any disease.

You are responsible for your own health decisions. If you have a medical condition, are pregnant, nursing, taking medication, have a history of disordered eating, or are under medical supervision, consult a qualified healthcare professional before using the App or making changes to your diet, exercise, supplements, or lifestyle.

If you think you may be experiencing a medical emergency, call emergency services immediately.

Assumption of Risk

Your use of the App and any decisions or actions you take based on information provided by the App are entirely at your own risk. You understand that nutrition and wellness activities carry inherent risks, and you voluntarily assume all risks of injury, illness, adverse effects, damages, or losses arising from your use of the App.

No Guarantees of Results

We do not guarantee any particular results, including weight loss, improved health outcomes, performance improvements, or any other wellness-related outcome. Results vary between individuals and depend on many factors outside our control.

Your Responsibilities

You agree that you will:

• Provide accurate information where requested and keep your account information up to date.
• Use the App only for lawful purposes and in compliance with these Terms.
• Use your own judgment before acting on any information presented in the App.
• Not rely on the App as a substitute for professional medical care.
• Maintain the confidentiality of your login credentials and promptly notify us of unauthorized access.

Subscriptions, Billing, Renewal, Cancellation, and Refunds

Subscription Plans

The App may offer subscription plans, including monthly and yearly options. Subscription benefits are available only while your subscription is active.

Free Trials

We may offer free trial periods from time to time. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged through the applicable app store.

Billing and Auto-Renewal

Subscriptions are auto-renewing and will renew at the end of each billing period unless cancelled before renewal. Payment is processed through the Apple App Store or Google Play (each, an "App Store") using the payment method associated with your App Store account.

Cancellation

You must cancel your subscription through your App Store account settings. Deleting the App does not cancel your subscription. Cancellation takes effect at the end of the current billing period unless otherwise stated by the App Store.

Refunds

Refund requests are handled by the App Store and are subject to the App Store’s refund policies and procedures. To the maximum extent permitted by law, we do not provide refunds for purchases made through an App Store except where required by applicable law.

Price Changes

We may change subscription pricing or plans at any time to the extent permitted by the App Store and applicable law. Any price changes will be implemented in accordance with App Store rules, including any required notice and consent.

Acceptable Use and Prohibited Conduct

You agree not to:

• Use the App in any way that violates applicable law or regulation.
• Attempt to access, probe, or test the vulnerability of any system or network related to the App.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from the App except as permitted by law.
• Interfere with or disrupt the integrity or performance of the App.
• Upload or transmit any viruses, malware, or other harmful code.
• Use the App to harass, abuse, stalk, threaten, defame, or otherwise violate the rights of others.
• Use automated means (bots, scrapers) to access the App except where expressly permitted by us in writing.

We may investigate suspected violations and may suspend or terminate access as described in these Terms.

Intellectual Property

The App, including all software, features, content, designs, text, graphics, logos, trademarks, and other materials (collectively, "Yuna Content") are owned by or licensed to us and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.

Privacy

Our collection and use of information is described in our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy at /privacy-policy.

Third-Party Services and App Stores

The App may integrate with or link to third-party services. We do not control and are not responsible for third-party services, and your use of third-party services is at your own risk.

Your download, purchase, and subscription through an App Store is also subject to that App Store’s terms and policies. In the event of a conflict between these Terms and an App Store’s terms regarding payments and refunds, the App Store’s terms will govern as to payments and refunds.

Termination

We may suspend or terminate your access to the App at any time, with or without notice, at our sole discretion, including if we believe you have violated these Terms or if your use creates risk for us or others.

Upon termination, your right to use the App will immediately cease. Sections intended to survive termination will survive, including those relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

Disclaimers

The App and all content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that any data or content will be accurate, complete, or reliable.

Limitation of Liability

To the maximum extent permitted by law, in no event will Yuna, Yuna App, or their founders, officers, directors, employees, contractors, agents, affiliates, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the App.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the App or these Terms will not exceed the total subscription fees you paid for the App in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Yuna, Yuna App, and their founders, officers, directors, employees, contractors, agents, affiliates, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your access to or use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) your content or data submitted through the App.

Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to these Terms or the App will be governed by the laws of Canada, without regard to conflict of laws principles. Subject to the dispute resolution section below (if applicable), you agree to the exclusive jurisdiction and venue of the courts located in Canada for any permitted court proceedings.
